Shipping Policy

Greetings Vape Hut Customers,

WE ARE STILL SHIPPING ORDERS TO AS MANY CUSTOMERS AS POSSIBLE! New shipping requirements include possible additional taxes to be applied to some orders, increased shipping fees, and we only take orders by phone. Under the new law, all packages sent through the mail must be reported to the state of delivery. All applicable vape taxes in each state must be reported. To ensure that all legal requirements under law have been met, we will only accept orders by phone. WE ARE UNABLE TO SHIP TO ALL STATES! Read below to see how the new law may affect our ability to ship to your state.

As we all know, the vape industry has been under attack for a few years now. The Government of the free people of the United States cares more about taking our freedoms away and lining their pockets than they do about saving lives. As such, the Vape Mail Ban (S 1253) was signed into law (it was one of the wish list items stuffed into the COVID relief bill) and will impact our ability to ship all vape products.

Vape Hut has filed the necessary documentation to be complaint with the PACT act. We are committed to compliance for as long as it is feasibly possible. Shipping will continue from Vape Hut, but there will be some changes for consumers:

INCREASED SHIPPING PRICES - SHIPPING FEE IS NOW A FLAT RATE OF $14.99.

Many carriers (FedEx, UPS, etc.) have already discontinued shipping of vapor products and USPS may stop as well. They have not made an announcement as to what they will do yet, but in the meantime,

After Friday, March 26, shipping through USPS will require an adult signature upon delivery for all packages. All packages must be sent Priority Mail, so our shipping rate is now a flat rate of $14.99. This fee is not charged for orders that are placed online and picked up in one of our stores.

When USPS issues their guidelines and restrictions, we are expecting that shipping with them will cease. We are currently searching for private carriers that may help us with this dilemma.

SHIPPING DELAYS AND POSSIBLE EXCLUSIONS TO CERTAIN STATES

We may shut the online store down between 3/27/21-3/31/21 to complete everything we need to for compliancy. In this case, we will resume shipping as possible on 4/1/21.

Due to compliance regulations, packages may be delayed. We usually ship same day, but expect some delays. We are still working out the kinks, but it may slow things down a little. We honestly don’t know exactly what to expect. This is new for us too, so please be patient. There may also be states that we are no longer able to ship to. If so, we will also post that information below in the “Municipal Vaping Restrictions” section.

INCREASED TAXES FOR ONLINE ORDERS

Under the PACT Act, companies have to submit documentation to the government for every customer shipped to and what they ordered. All applicable taxes have to be paid to each state from which customers order. States have different requirements for compliance, so at this time, some states are requiring sales/use taxes and nicotine/tobacco taxes, and some do not. Whether or not your invoice will include these taxes depends on what state you are ordering from.

Our system is set up to automatically include some of the taxes, but may not be set up to include all of them on your initial invoice. Before processing your order, we will review it, and if your invoice total does not include a required tax, we will contact you by phone or email to update the invoice. We must make sure the order is in compliance before we are able to ship it to you, so please make sure the contact information you provide is up to date!

AFFIXED NOTICE ON THE OUTSIDE OF YOUR PACKAGE

Each package will have an affixed label on the outside of the box that states:

“CIGARETTES/NICOTINE/SMOKELESS TOBACCO: FEDERAL LAW REQUIRES THE PAYMENT OF ALL APPLICABLE EXCISE TAXES, AND COMPLIANCE WITH APPLICABLE LICENSING AND TAX-STAMPING OBLIGATIONS”

MUNICIPAL VAPING RESTRICTIONS

Chicago, IL

  • Flavored eliquids that contain nicotine can no longer be shipped to Chicago
  • Flavored disposable vapes that contain nicotine can no longer be shipped to Chicago
  • Flavored eliquids that do not contain nicotine can still be shipped
  • Tobacco eliquids than contain nicotine are still permitted
  • Vaping hardware such as coils, batteries and e-cigarettes are still permitted
  • Does not impact suburban Cook County

New York

Online sales of vapor products are banned.

San Fransico, CA

  • We will no longer ship orders to San Francisco, CA
  • All vape and vapor products are prohibited.
  • These rules apply to online orders.
  • Ordinance signed by Mayor of July 1st, 2019

Vermont

Online sales of vapor products are banned.

New Jersey

  • New Jersey Flavor ban takes effect on 4/20/2020
  • Only tobacco ejuices, pods and flavors permitted.

Massachusetts

  • The total vape ban was lifted on 12/11/2019
  • Orders must be placed over the phone at (844)-827-3454 rather than online.
  • A signature from an adult 21 or older will be required upon delivery.
  • Only tobacco vapes with a nic strength of less than 3.5 percent are permitted.

Rhode Island

  • All nicotine ejuice flavors banned except tobacco.
  • Tobacco cartridges, pods and ejuices still permitted.
  • Hardware and accessories not effected.
  • These rules apply to online orders..

Arkansas

  • Due to Act 1235 which was passed by the Arkansas General Assembly, we are unable to ship to Arkansas. The full text of the Bill can be viewed by clicking here.

Maine

  • Maine defines vapor products as "tobacco". Tobacco products may not be shipped to anyone other than a licensed retailer or distributor in the state, effectively banning out-of-state online and phone sales.

South Dakota

  • South Dakota considers vape products to be tobacco. The shipping of any tobacco products to any consumer in South Dakota, whether the seller is located in South Dakota or not, is prohibited.

Utah

  • All sales of tobacco and vapor products must be face-to-face, effectively banning online sales.
